Whoever, without the written permission of the [Municipality]1 digs up or removes earth, sand or other material from any open space, whether vested in the [Municipality]1 or not, which is not private property, shall be liable upon conviction to a fine not exceeding five hundred rupees, and, if the offence is a continuing offence, to a further fine not exceeding ten rupees for every day during which the offence continues after the date of the first conviction for such offence.
