(1) A Market Committee may make bye-laws not in consultant with this Act and the rules made thereunder, to provide for :- (1) regulation of its business ; (2) appointment, powers, duties and functions of the sub- committee, if any, appointed under clause (vii) of section 17 ; (3) duties of traders, brokers, commission agents, ware-housemen, weighmen and palledars ; and (4) any other matter which by or under this Act is required to be provided for by bye-laws : [Provided that no bye-law, other than a bye-law made by adopting draft or model bye-law suggested by the [Board]2, shall be valid unless approved by the [Board]2.]1 (2) If, in respect of any matter specified in sub-section (1), the Committee has failed to make any bye-laws or if the bye-laws made by the Committee are not, in the opinion of the [Board]2, adequate, the [Board]2 may make bye-laws providing for such matters to such extent as it thinks fit. [(3) The power under this section to make bye-laws shall be exercised subject to any general or special directions issued by the State Government in that behalf.]4 [Submission of statement of purchases and sales 39-A Every Whole sale trader or commission agent, shall before the thirtieth day of April every year submit to the Market Committee a statement of purchases and sales of specified agricultural produce or through him during the previous year in such form and in such manner and setting fourth such other particulars as may be specified in the bye-laws. Explanation— For the purposes of this section, ‘previous year’ means the financial year immediately proceeding the year in which such statement is required to be submitted.]5 1- Subs.
