(1) All agreements made within a period of twelve years prior to the date on which this Act comes into force regarding the construction, repair and maintenance of a minor irrigation work which might. have been constructed or maintained under this Act, had it been in force, shall, so far as the terms thereof are consistent with this Act, be deemed to have been made under this Act, and shall have force accordingly. 183 [The United Provinces Minor Irrigation Works Act, 1920] [Section 28-31] (2) Nothing in sub-section (1) shall apply to any such agreement in respect of a minor irrigation work unless and until the [State Government]1 declares the work by notification in the [official Gazette]2 to be subject to the provisions of this [section]3.
