Section 78

Pensions and dismissal in case of servants of the Government employed by Municipality or vice versa

Special provisions as to certain servants 78. (1) A Municipality shall contribute to the pension and leave allowances of any servant - (a) whose services are lent or transferred by Government to the Municipality, or (b) whose services are lent or transferred by the Municipality to Government, or (c) who is employed partly by Government and partly by the Municipality. (2) Such contribution shall be to the extent prescribed by any general rules 1 or special orders made by 2 [ the Government concerned ] (3) A Municipality shall not, without the assent of Government, dispense with the services of any servant described in clause (a) or (c) of sub-section (1) or finally dismiss from its service any servant described in clause (b) of sub-section (1), unless it has given Government at least six months notice. (4) In this section "Government" shall mean the 3 [ Central Government ] or any 4 [ State Government. ]
