27. The 1 [ District Judge ] may declare any candidate found to have committed any corrupt practice to be incapable, for any period not exceeding five years, of being elected as a member of the Municipality or of being appointed or retained in any office or place in the gift or disposal of the Municipality : [ Provided that no such declaration shall be made about any candidate who was not a party to the election petition or who was not given an opportunity of being heard under section 26. ]
