Section 549

State Governments power to make byelaws and regulations

549. (1) If in respect of any matters specified in section 541 the 1 [Corporation] has failed to make any bye-law or if the bye-laws made by the 1 [Corporation] are not, in the opinion of the State Government, adequate, the State Government may make bye-laws, providing for such matter to such extent as it may think fit. (2) The provisions of section 543 shall apply to the making of bye-laws under this section with the substitution of the words "State Government" for the words " 1 [Corporation]" and the bye-laws shall have force of law upon their publication in the official Gazette . (3) If any provision of a bye-law made under this section is repugnant to any provision of a bye-law made by the 1 [Corporation] the bye-law under this section shall prevail and the bye-law made under section 541 shall, to the extent of the repugnancy, be void. (4) The State Government may, if it thinks fit by publication in the official Gazette , make regulations consistent with this Act and the rules and bye-laws in respect of matter referred to in clause (f) of subsection (1) of section 548.
