Section 122

Power of the 1Corporation to require 2Municipal Commissioner to produce documents and furnish returns, reports, etc.

(1) The 1 [Corporation] or the Executive Committee may at any time require the 2 [Municipal Commissioner]-- (a) to produce any record, correspondence, plan or other document which is in his possession or under his control as 2 [Municipal Commissioner] or which is recorded on files in his office or in the office of any 1 [Corporation] officer or servant subordinate to him; (b) to furnish any return, plan, estimate, statement, account or statistics concerning or connected with any matter appertaining to the administration of this Act or the municipal administration of the City ; (c) to furnish a report by himself or to obtain from any officer subordinate to him and furnish, with his own officer subordinate to him and furnish, with his own remarks thereon, a report, upon any subject concerning or connected with the administration of this Act or the municipal administration of the City. (2) The Municipal Commissioner shall comply with every such requisition unless in his opinion immediate compliance therewith would be prejudicial to the interest of the Corporation or of the public, in which case he shall make a declaration in writing to that effect and shall if required by the 1Corporation or the Executive Committee refer the question to the 2 [Mayor] whose decision shall be final.
