Section 97

Disputes regarding exercise and performance of powers, Duties and functions

97. (1) In case any doubt arises as to whether the 1 [Zila Panchayat], the Adhyaksha, the Karya Samiti, the Vitta Samiti, the Mukhya Adhikari or any other committee or officer of the 1 [Zila Panchayat] is the proper authority for the exercise of any power or the performance of any duty or function under this Act, the matter shall be referred by the Mukhya Adhikari to the State Government whose decision shall be final. (2) In case any doubt arises as to whether the 2 [Kshettra Panchayat] the Pramukh, the 3 [Karya Samiti, the Vitta Evam Vikas Samiti, the Shiksha Samiti and the Samata Samiti], the Khand Vikas Adhikari or any other committee or officer of a 2 [Kshettra Panchayat] is the proper authority for the exercise of any power or the performance of any duty or function under this act, the matter shall be referred to the District Magistrate whose decision shall be final. In making any such decision, the District Magistrate shall be guided by such general directions as may be issued in this behalf by the State Government from time to time.
