46. (1) Notwithstanding anything contained in this Act and the statutes the first Vice-Chancellor shall be appointed by the State Government for three years in such manner and on such conditions as may be deemed fit. The Vice-Chancellor may, with the previous approval of the State Government and subject to the availability of funds, discharge all or any of the functions of the University for the purpose of carrying out the provisions of this Act and the Statutes and for that purpose he may exercise any power or perform any duties, which by this Act and the Statutes are to be exercised or performed by any authority of the University until such authority comes into existence as provided by this Act and the statues. (2) Till such time as the first Ordinances are not made under sub-section (2) of section 37, in respect of the matters that are to be provided for by the Ordinances under or the Statutes under this Act, the relevant provisions of the Statutes and the Ordinances made immediately before the commencement of this Act under the provisions of the Uttar Pradesh Jagadguru Rambhadracharya Divyang University Act, 2001 (U.P. Act 32 of 2001) shall be applicable insofar as they are not inconsistent with the provisions of this Act.
