Section 26

( 1) The Chairperson shall cease to hold office if he ceases to be a Term of member of the Nagar Panchayat. office of the Chairperson. (2) The Chairperson may at any time by giving a notice in writing to the Vice-Chairpersn or if there is no Vice-Chairperson, to the Nagar Panchayat, resign his office and the procedure for acceptance or otherwise of the resignation shall be such as may be prescribed. (3) The Chairperson may be removed from office by a resolution carried by a majority of the total number of elected members of the Nagar Panchayat at a special meeting to be called for this purpose in the manner prescribed upon a requisition made in writing by not less than one third of the total number of elected members of the Nagar Panchayat and the procedure for conduct of business in the special meeting shall be such as may be prescribed : Provided that no such resolution shall be moved before the expiry of six months from the date of assumption of office by the Chairperson and if such resolution is not carried by a majority of the total number of elected members, no further resolution for such purpose shall be moved before the expiry of a period of six months from the date on which the former resolution was moved. (4) Notwithstanding anything contained in this section, the Chairperson of a Nagar Panchayat whose office becomes vacant under any of the I lrtserred hy Tlrc Trip~rru M~rr~rcipcrl (Arnerrclr~~cr~t) Acr. 2000. w.e.5 6.10.2000. provisions of this section shall continue to hold office as Chairperson until his successor enters upon his office.
