(1) The Registrar or any officer subordinate to him and empowered by him in this behalf may, subject to such rules as may be made by the Government but without prejudice to any other mode of recovery provided by or under this Act, recover,-- (a) any amount due under a decree or order of a civil court obtained by a society; (b) any amount due under a decision, award or order of the Registrar, or any officer subordinate to him and empowered by him in this behalf, arbitrator or Liquidator or Tribunal ; (c) any sum awarded by way of cost under this Act ; (d) any sum ordered to be paid under this Act, as a contribution to the assets of the society ; together with interest, if any, due on such amount or sum and the costs of process by the attachment and sale or by sale without attachment of the property of the person or a society against whom such decree, decision, award or order has been obtained or passed ; (e) any amount due under a certificate granted by the Registrar under sub- section (1) or (2) of section 104 or under sub-section (1) of section 138. Recovery of sums due to Government Registrar’s powers to recover certain sums by attachment and sale of property. 36 of 1963 77 (2) The Registrar or the officer empowered by him shall be deemed, when exercising the powers for the recovery of an amount by attachment and sale or by sale without attachment of any property, under the foregoing sub-section, or when passing any orders on any application made to him for such recovery or to take steps in aid of such recovery to be a civil court for the purpose of article 182 in the First Schedule to the Limitation Act, 1963. 156.(1) The Government may, by general or special order, to be published in the Official Gazette, exempt any society or class of societies from any of the provisions of this Act, or may direct that such provisions shall apply to such society or class of societies with such modifications not affecting the substance thereof as may be specified in the order ; “(2) “No Co-operative Credit Structure Society shall be exempted from the application of the provisions of this Act without consultation with ReserveBank of India or National Bank for Agriculture and Rural Development” “Explanation: The process of consultation may be completed within thirty days. The period of thirty days will be counted from the date on which the proposal is first sent to any office of RBI or NABARD. The views of the State Government after the period of consultation shall be final.”*1 Provided that no order to the prejudice of any society shall be passed without an opportunity being given to such society to represent its case.
