Punishment for cruelty to child.—(1) Whoever, having the actual charge of, or control over, a child assaults, abandons, exposes or wilfully neglects the child or causes or procures him to be assaulted, abandoned, exposed or neglected in a manner likely to cause such child unnecessary mental and physical suffering shall be punishable with imprisonment for a term which may extend to six months, or with fine, or with both: Provided that in the case of married children the children's court trying the offence under this section may sanction its composition for reasons to be recorded in writing. (2) The infliction of reasonable punishment by parent or guardian having the actual charge of a child for proper training, protecting himself against moral dangers or exploitation, and to ensure growth and development of his personality shall not be deemed to be an offence under this section. (3) No court shall take cognizance of an offence punishable under sub-section (1) makes the complaint is filed with the previous sanction of the State Government or an officer authorised by it in this behalf.
