Section 29

(1) The Sarpanch, Upa-Sarpanch or any member may resign his office in the manner prescribed

(1) The Sarpanch, Upa-Sarpanch or any member may resign his office in the manner prescribed. (2) (a) Notwithstanding that the resignation of a person from the office has taken effect under sub-section (1) the District Collector may by notification record a finding, with reasons therefor, that such person is guilty of willful omission or refusal to carry out, or disobedience of, the provisions of the Act or any rules, bye-laws, regulations or lawful orders made thereunder or abuse of the powers vested in him, while he held the office: Bar of Jurisdiction. [Act No.5 of 2018] 47 Provided that the District Collector shall before issuing such notification give the person concerned an opportunity for explanation: Provided further that no action under this clause shall be taken after the expiration of one year from the date on which the resignation has taken effect; (b) A person aggrieved by the notification issued under clause (a) may, within thirty days from the date of publication of such notification prefer an appeal to the Commissioner and the Commissioner shall in case the appeal is allowed, cancel such notification; (c) A person in respect of whom a notification was issued under clause (a) shall, unless the notification is cancelled under clause (b), be ineligible for election for a period of three years from the date of publication of such notification.
