Validation of certain transfers of land and conferment of pattadari rights on transferees. 36 [Act No.VIII of 1317 F.] Shikmidar to the former pattadar for the year 1952 and the land revenue paid or payable for that year by the former pattadar to the Government in respect of that land. (4) Where the transferee fails to pay, in the manner and within the time prescribed, the reasonable price for the land in respect of which he has applied to be declared as pattadar under sub-section (1), as determined by the Deputy Collector, the amount so payable shall be recovered from the transferee as an arrear of land revenue in the following manner and paid to the former pattadar referred to in sub-section (2), of the land,- (a) by the sale of the properties, if any, of the transferee other than the land in respect of which the reasonable price is payable; (b) where he has no properties other than such land or where the amounts realised from such properties falls short of the reasonable price, by the sale of such land. (5) The Deputy Collector shall after satisfying himself that the price payable to the former pattadar referred to in sub-section (2) has been paid or has been deposited within such time and in such manner as may be prescribed, require the transferee to deposit in the office of the Deputy Collector an amount equal to the registration fees and the stamp duty that would have been payable had the transfer been effected by a registered document in accordance with the provisions of the Indian Registration Act, 1908. On the deposit of such amount, the Deputy Collector shall issue a certificate in the prescribed form to the transferee declaring him as pattadar of that land and such certificate shall, notwithstanding anything in the Indian Registration Act, 1908, be conclusive evidence of such transfer.
