Who ever,- (a) contravenes any of the provisions of this Act, mentioned in the first column of the Second Schedule; or (b) fails to comply with any order or direction lawfully given to him or any requisition lawfully made upon him Penalties for certain offences. 34 [Act No. 15 of 1989] under any of the said provisions, shall be an offence punishable- (i) in the case of the first offence with fine which may extend to the amount specified in that behalf in the third column of the said Schedule or with simple imprisonment for a term which may extend to one month or with both and in the case of second or subsequent offence with fine which shall not be less than one thousand rupees but which may extend to two thousand rupees or with simple imprisonment for a tetm which shall not be less than one month but which may extend to two months or with both; (ii) in the case of a continuing contravention or failure, with daily fine which may extend to the amount specified in the fourth column of that Schedule for every day during which such contravention or failure continues after conviction.
