(1) Where a trustee of any charitable or religious institution or endowment,- Vacancy in the office of trustee and filling of such vacancy. 30 [Act No. 30 of 1987] (a) becomes subject to any disqualification specified in sub-sections (1) and (3) of section 19 and is removed under section 28; or (b) tenders resignation of his office and the same is accepted by the Government, the Commissioner, the Deputy Commissioner, or the. Assistant Commissioner, as the case may be, his office shall there upon become vacant. (2) Where a vacancy in the office of a trustee has arisen under sub-section (1), or by efflux of time, or otherwise the Government, the Commissioner, the Deputy Commissioner or the Assistant Commissioner, as the case may be, shall appoint a new trustee in his place and such trustee shall hold office for the residue of the term of office of his predecessor except where the vacancy has arisen by efflux of time.
