In section 121 of the principal Act,— (1) in sub-section (2), the following expression shall be added at the end, namely:— “and recover the cost from the person on whom such notice is served.”; (2) after sub-section (2) as so amended, the following sub-section shall be added, namely:— “(3) Whoever makes a layout or a new private street without the prior sanction of the Commissioner, shall on conviction be punishable with imprisonment which may extend to one year and with fine which may extend to one lakh rupees and in case of continuing contravention, a further such sum which shall not exceed one thousand rupees per day during which such contravention continues.”. 185 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY
