(1) The offences under section 71 shall be cognizable under the Bharatiya Nagrik Suraksha Sanhita, 2023 (46 of 2023.), but no action shall be taken in respect of any person for the offence under this Act except upon a written complaint made by a person duly authorised by the Central Government or the Board: Provided that proceedings in respect of offences under sub-section (4) of section 71 shall not be instituted except with the consent of the Attorney-General for India. (2) No court inferior to that of a Judicial Magistrate of the first class shall try any offence under this Act.
