(1) Whoever suffers nuclear damage shall be entitled to claim compensation in accordance with the provisions of this Act. (2) For the purposes of adjudicating upon claims for compensation in respect of nuclear damage, the Central Government shall, within such period not exceeding thirty days from the date of notification of nuclear incident under section 26, designate by notification, one or more officers not below the rank of Joint Secretary to the Government of India, as Claims Commissioner for such area and subject to such terms and conditions, as may be specified in that notification.
