The operator of the nuclear installation, after paying the compensation for nuclear damage as specified in the Second Schedule, shall have a right of recourse where-- (a) such right is expressly provided for in a contract in writing; or (b) the nuclear incident has occurred as a result of commission or omission of an individual with an intention to cause nuclear damage.
