Notwithstanding anything contained in the law relating to criminal procedure in force in Sikkim , - (a) no court shall take cognizance of an offence punishable under this Act except upon a complaint, in writing, made by thc Controller or any other officer authorised in this behalf by the controller by gene- ral or special order; (b) no court inferior to that of a Judicial Magistrate of the First Class shall try any offence under this Act; (c) any offence punishable under section 34, 36, 37, 38, 39, 40, 43, 49, 50, 51 or sub-section (3) of section 69 may be tried summarily by a M.agistrate .and no sentence of imprisonment for a term exceeding one year shall be passed in the case of any conviction for an offence which is tried surnmarilv under this section.
