(I) Where the sale of any commodity is made by number and, the number of the commodity delivered to the purchaser in pursuance of such sale is lesser than the number paid for, the seller shall he deemed to have used a f~dse measure. (2) Where, in relation to any commodity sold by number, there is a custom or usage of delivering a fixed number or such commodities in addition to the number of cornmoditioes paid for, such custom or usitge shall, on and from the com- mencement of this Act, cease, and if the seller delivers to the purchaser the additional number of commodities in accordance with such custom or or usage, he shall be deemed to have used a false measure and the purchaser shall be deemed to have abetted the use of such false measure.
