(I) All the notifications, rules, regulations and orders relating to shops and Repeal and Savings. establishments in Sikkim in force immedLtely before the commencement of this Act are hereby repealed. (2) Notwithstanding such repeal anything done or any action taken under the notifications, rules, regulations, orders, on the subject, shall be deemed to have been done or taken, as far as may be, under the corresponding provisions of this Act. 18 STATEMENT OF OBJECTS AND REASONS During last few years a large number of shops and commercial establishments have been establi~hed in the State of Sikkim and it is expected that their number is likely to increase in the near future. This will re- sult in the mployment of a large number of people. It is felt that legal provisions are required to protect the interests of these people. The Sikkim Shops an'd Commercial Establishment Bill, 1983 provides for the regu- lation of condition of work and employment in shops, commercial establishments, residential hotels, .restaurants eating houses, theatres and other places of amusement or entertainment and other establishments. . MEMORANDUM REGARDING DELEGATED LEGISLATION The Bill confers on the State Government power to make rules for giving effect to provisions of the Bill. The matters in respect of which rules may be made relate, interelia to the appointment of prescribed authority, the manner of registration and fees for renewal of registration certificate, maintenance of records etc. ' The matters in respect of which rules may be made relate to administrative details 'andprocedure. As such, the delegation of legislative power is normal in character. FINANCIAL MEMORANDUM Clause 68 of the Bill empowers the State Government to appoint as many Inspectors as it may consider necessary and to designate one of the Inspectors as the Chief Inspector for the purposes of enforcing the provisions of this Bill. It is proposed to enforce the provisions of the Bill in the G.M.C. area at the first instant. For this purpose it may be necessary to have at least I Chief Inspector and 2 Inspectors. Asan interim arrangement, it has been proposed that the Under Secretary in the Department be designated as the Chief Ins- pector and the existing 2 Labour Inspectors as the Inspectors under the Act. As such, no expenditure shall be involved during the Current Financial Year. However, budget provision shall be made in the subsequent year for the appointment of other Inspectors and connected officials when the Act is extended to other areas in the State of Sikkim.
