No Magistrate shall take congnizance of an offence punishable under Section 10, except : (a) upon a report in writing of the facts constituting such offence made by an officer-in-charge of the police station; or (b) upon information received from any person other than an officer-in-charge of the police station or upon his own knowledge of suspicion, that such offence has been committed
