(1) Subject to the provisions of this Act and the rules and guidelines made thereunder, a procuring entity may choose to,- (a) call for bids in which the technical, quality and performance aspects, commercial terms and conditions and the financial aspects including the price are contained in a single envelope; or (b) if it is of the opinion that it is essential to evaluate the technical aspects of a bid before considering its financial aspect, call for bids in two envelopes, namely:- (i) the techno-commercial bid containing the technical, quality and performance aspects, commercial terms and conditions; and (ii) the financial bid containing financial aspects, including the price. (2) In case the procuring entity calls for bids in terms of clause (b) of sub-section (1), the techno-commercial bid shall be opened and evaluated first and the financial bid of only those bidders that have been found technically acceptable shall be opened and evaluated.
