(1) All members, officers and employees of the Council shall be deemed, while acting or purporting to act in pursuance of any provisions of this Act, to be public servants within the meaning of section 21 of the Indian Penal Code, 1860 (Central Act 45 of 1860). (2) Every person entrusted with the duties of supervision or conducting inspection work at any institution which is affiliated or seeking affiliation to the Council, shall during the period of such inspection as well as for a period of one month prior to the date of commencement of and two months after the closing of such inspection, be deemed to be public servants within the meaning of section 21 of the Indian Penal Code, 1860 (Central Act 45 of 1860).
