Negotiations of contracts Negotiation may41 be resorted to when there is only one bidder complying with the stipulated pre-qualification conditions (hereinafter referred to as the “Complying Bidder”) as defined hereunder:- (i) if after advertisement, only one concessionaire applied for pre-qualification and it meets the pre-qualification requirements; (ii) if after advertisement, more than one concessionaire applied for pre- qualification, but only one meets the pre-qualification requirements; (iii) if after pre qualification of more than one concessionaires, only one submits a bid; and 41 As amended vide notification no.31-Leg./2003 dated 03.11.2003 PUNJAB GOVT. GAZ. (EXTRA.), JULY 9, 2002 (ASAR 18, 1924 SAKA) 31 (iv) if after pre-qualification, more than one concessionaires submit bids, but only one is found by the Board to be Complying Bidder. Provided that, any of the aggrieved disqualified bidder may, within a period of fifteen days from the date of decision of the Board, file appeal to the Authority and the same shall be decided by the Authority within a period of twenty-one days from the date of filing of the appeal.
