(1) If at any election any ballet box used at a potting station or any other place fixed for the Poll is unlawfully taken out of the custody of the Presiding Officer or is in any way tampered with or is intentionally or unintentionally destroyed, lost or damaged, the Presiding Officer will immediately submit report of facts to the Returning Officer who will forward it to the Commission with his comments and if the Commission is satisfied, on receipt of the report of the Presiding Officer through the Returning Officer, that in consequence thereof the result of the poll on that polling station cannot be ascertained; the Commission nay— (a) declare the polling at that polling station to be void; (b) appoint a day and fix the ;ours for taking a fresh poll at the polling station ; and (c) notify the day so appointed and the hour so fixed in the manner prescribed under these rules; (2) The provisions of these rules shall apply to every fresh poll as they apply to the original poll.
