Bill-sticking without permission:- 3[(1) Whoever, without the consent of the owner or occupier or other persons for the time being in charge, affixes any posting bill, notice placard or other paper or means of advertisement against or upon any building, wall, tree, board, fence or pale or writes upon, soils defaces or marks any such building, wall, tree, board, fence or pale, with chalk or paint or in any other way whatsoever, shall be punishable with fine which may extend to 4[five hundred ru- pees.] 5[(2) Notwithstanding anything contained in section 228 a court may take cogni- zance of an offence under sub- section (1) of this section upon the complaint of the owner or occupier or other person in charge of the property in respect of which such offence is alleged to have been committed.] Section 179
