(1) If there is an outbreak of fire in a low-risk building which results either in the loss of life or grievous hurt, and the fire is attributable to the failure of the erector of a building to comply with fire prevention and life safety measures in that building, then the erector shall be imprisoned for a period which may extend upto one year. (2) If there is an outbreak of fire in a medium or high-risk building which results either in the loss of life or grievous hurt, and the fire is attributable to the failure of the erector of a building to comply with fire prevention and life safety measures in that building, then the erector shall be imprisoned for a period which may extend upto two years. Explanation: For the purposes of this section, the term ‘grievous hurt’ shall have the same meaning as the term ‘grievous hurt’ as defined in section 116 of the Bharatiya Nyaya Sanhita, 2023 (Central Act 45 of 2023).
