(1) For all offences specified in Parts B and D of this Chapter, irrespective of whether different penalties are prescribed for buildings and pandals with different risk- classifications, the orders for penalties may be issued, unless otherwise prescribed by the Government from time to time,- (i) in the case of low-risk buildings and pandals, by a Fire Officer not below the rank of Station Fire Officer; and (ii) in the case of medium and high-risk buildings and pandals, by a Fire Officer at the rank higher than the Station Fire Officer. (2) In case of offences specified in Part C of this chapter, the orders for penalties shall be issued by the concerned Fire Officer: Provided that in case of all offences committed with respect to a response to some emergency, the order for penalties shall be issued by the commanding officer for that response.
