Accused not in exclusive possession of house

Accused not in exclusive possession of house. - Where it cannot be said that the accused was in sole possession of the house wherefrom the incrinating articles (liquor and other articles) were recovered and it is clear that when the recovery was made, the accused was sleeping and it is not clear that the accused was incharge of the incriminating articles at the time when they were recovered, and the possibility of some one having started the still cannot be ruled out especially when there were other persons besides the accused living in the house, the accused cannot be convicted under Section 48.
