Eye-witness. - Accused found distilling illicit liquor by working a still. Component and 12 bottles of illicit liquor taken into possession. Eye witness not supporting the prosecution story. Official witnesses statements discrepant. Not safe to convict the petitioner merely on the testimony of official witness. Conviction can be maintained on the sole testimony of the police officials if the same inspires confidence and they have no animus against the accused. But in the present case, the Head Constable seems to be inimical towards the petitioner and the independent eye-witness, as observed earlier have not supported the prosecution ver- sion. In this situation, I am of the considered view that it is not safe to maintain the conviction of the petitioner on the testimony of the Head Constable and Constable Gulab Singh.
