Name of the accused not mentioned in F.I.R. - The mention of the name of an ac- cused person in the F .LR. is of considerable importance in a criminal case but omission of the name of an accused person from the F .LR. by itself is not always fatal to the prosecution case, nor is enough to justify the conclusion that the accused concerned has been falsely implicated. The value which has to be attached to the F.I.R. has to be judged in the light of various circumstances including the nature of the crime, the position of the informant and the opportunity which he had to witness the part which each of the accused played.
