Discretion of presiding officer to demand whole bid money is valid. - The Presiding Officer of the auction of liquor vends has to be a very high officer in the hierarchy of the Excise Authorities. The auction was conducted by Collector-cum-Deputy Excise and Taxation Commissioner of the Union Territory of Chandigarh. It was observed by the Court that with his experience in the filed of auction of liquor vends and with the information and data avail- able to him regarding the fixed quota of a particular vend, the amount which it was given dur- ing the previous year, the nature of the locality whose needs the vend has to cater, and the type of population which is expected to become customers at the vend he should be the best person to form an idea as to how the bidding for a particular vend has become excessively high.
