Plea of guilty. - An accused cannot be convicted inspite of his plea of guilty where the facts stated in the challan and particulars of offence put to him do not constitute an offence. It is open to Magistrate to accept the plea of guilty and convict accused on his own admission if put forward at initial stage but there is no provision under which court can accept such plea and base conviction when prosecution evidence has been let in and trial commenced.
