Offences under Excise Act - Whether cognizable? - Under section 4(6) of the Cr. P.Code cognizable offence means an offence for which a police officer within or without the Presidency town, may in accordance with the second schedule or under any law for the time being in force, arrest without warrant. Under section 47 of the Punjab Excise Act, the offences under section 61 and 63 are cognizable under the above definition.
