"Accused of an offence" - Meaning. Where evidence, whether oral or circumstantial, points to the guilt of a person and he is taken in custody and interrogated on that basis he becomes a person accused of an offence. The mere fact that his name was not mentioned as accused in F.I.R. will not take him out of that category. The moment suspicion attaches to him he for all purposes becomes an accused person and any self incriminatory statement made by him subsequently IS inadmissible in evidence against him if it is induced by any promise, threat or violence.
