(1) Notwithstanding anything to the contrary contained in any law, or in any judgment, decree or order of court, where any holding has been sold after the 22nd day of March, 1968 and before the commencement of the Mahe Land Reforms (Amendment) Act, 1980, for recovery of damages for committing waste on the holding, but the tenant has not been dispossessed, such tenant may, within six months from such commencement, deposit in court an amount equal to the purchase money together with interest at the rate of six per cent per annum and apply to the court for setting aside the sale. (2) The court shall, if satisfied after such summary enquiry as the court deems fit, set aside the sale and may also order the applicant to deposit the costs, if any, payable to the decree-holder (3) Where the amount deposited under sub-section (1) is not found sufficient, the court shall not pass an order under sub-section (2) unless the deficit amount is deposited in court within such period as the court may direct. (4) Where the holding has been sold to a purchaser other than the decree- holder, such person shall be entitled to an order from the court for repayment of his purchase money, with or without interest as the court may direct, against any person to whom it has been paid].
