Notwithstanding anything in this Act instead Altcrnalivc of proceeding against the defaulter by distress and by sale as hereinbefore provided or after a defaulter has been so proceeded against unsuccessfulIy or with partial success, any surn due or the balance of any sum due. as the case may be, from such defaulter on account of any rates, damages, expenses, or costs, may be recovered by a suit in a court of competent jurisdic- tion.
