(1) In this Act, unless the context otherwise requires:- (a) (b) “Academic Council” means the Academic Council of the University constituted under section 24; “AICTE” means the All India Council for Technical Education established under section 3 of the All India Council for Technical Education Act, 1987; “‘Annual Report’ means the Annual Report of the University referred to in Section 49; “appointed date” means the date appointed under sub-section (1) of Section 3; “Board of Governors” means the Board of Governors of the University constituted under section 22; “Board of Management” means the Board of Management of the University constituted under section 23; “BPUT" means the Biju Patnaik University of Technology established under the Biju Patnaik University of Technology Act, 2002; “College” means National Institute of Science & Technology, Berhampur; “Corpus Fund” means Corpus Fund of the University referred to in section 45; “Dean” means Dean of Schools of the University referred to in Section 17; “Development Fund” means the Development Fund of the University referred to in Section 47; ‘Distance Education System” means the system of imparting education through any means of information technology and communication such as multimedia, broadcasting, telecasting, online over internet, other interactive methods, e-mail, internet, computer, interactive talk back, e-learning, correspondence course, seminar, contact programmes or a combination of any two or more of such means; 52 of 1987. Odisha Act9 of 2002 3 (m) “Employee” means employee appointed by the University and includes teachers and other staff of the University; (n) “Faculty” means a faculty of the University; (0) “Finance Officer” means Finance Officer of the University appointed under section 19; (p) “General Fund” means General Fund of the University referred to in Section 46; (q) “Off campus centre” means off campus centre as defined in the regulation 2.2 of U.G.C. (Establishment and Maintenance of Standards in Private University) Regulation, 2003, as amended from time to time; (r) “Prescribed” means prescribed by the Statutes; (s) “President” means the Chairman (Donor) of the Trust shall be the president of the University as referred to in Section 14; (t) “Registrar” means the Registrar of the University appointed under section 18; (u “Regulatory Body” means a body or authority, (by whatever name called), established by or under a Central or State Act for laying down norms and conditions for ensuring standard of higher education such as University Grants Commission, All India Council for Technical Education and National Council of Assessment and Accreditation, National Board of Accreditation, Distance Education Council, Pharmacy Council and other body includes such as the State Government may, by notification, declare from time to time; (v) “Rules” mean the Rules of the University; (w) “School” means the Schools of Studies of the university as provided in clauses (f) of Section 7; (x) “Sponsoring Body” means SM Charitable Educational Trust; (y) “State” means the State of Odisha; (z) “State Government” means the State Government of Odisha; (za)“Statutes” means the Statutes of the University; (zb) “Teache:” means a Professor, Associate Professor, Assistant Professor, Lecturer or such other person as may be appointed for imparting instruction or training or conducting research in the University; Establishment and incorporation 4 (zc)“Trust” means the SM Charitable Educational Trust, registered under the Indian Trust Act, 1882; (zd) “UGC" means the University Grants Commission established under the University Grants Commission Act, 1956; (ze)“University” means the NIST University, Odisha. (zf) “Vice-Chancellor” means the Vice-Chancellor of the University appointed under se;:tion 16; (zg)"Vice-President’ means the Vice-President of the University referred to in Section 15; and (zh)“Visitor" means the Visitor of the University as referred to in Section 12. CHAPTER Il THE UNIVERSITY 3.(1) Subject to provisions of Section 5 with effect from such date as the Government may, by notification, appoint in this behalf (hereinafter referred to as the appointed date), there shall be established in the State of Odisha a self-financed, private, unitary and non-affiliating University at Institute Park Pallur Hills in the district of Ganjam by the name of “NIST University, Odisha” after Corpus Fund is set up by the Sponsoring Body in accordance with the provisions of Section 45. (2) The University shall be a body corporate by the aforesaid name having perpetual succession and common seal with powers, subject to the provisions of this Act, to acquire, hold and dispose of property, both movable and immovable which may have become vested in, or may have been acquired by it, and to contract, and to do all things necessary for the purpose of this Act, and shall sue and be sued by the said name. (3) The headquarters of the University shall be at Pallur Hills in the District of Ganjam. (4) The jurisdiction of the University shall extend over all that is presently comprised of the College to be recognized, restructured and renamed under sub-section (1), to all schools of studies and Departments for which the 2 016882. 3of 1956 Effect of establishment. 5! corresponding degree and other academic distinction are being conferred by the BPUT and Berhampur University and to all schools of studies and Departments to be established by the University in future with prior permission of the State Government.
