Power to exclude road, bridge or drain from Act :– The State Government may, from time to time , by notification exclude from the operation of this Act or any specified section of this Act, any such public road, bridge, sewer, drain, drainage works, tunnels, culvert, rest-sheds and bunglows and may also modify and cancel such notification: Provided that if the cost of the construction of the works shall have been paid from the Municipal Fund, such work shall not be excluded from the operation of this Act or of any specified section of this Act without the consent of the municipality.
