Notwithstanding any judgement, decree or odrer of any court or tribunal or other authority. the gradation lists prepared in pursuance of cIause ($1 of sub-rule t2) of Rule 8 of theRecruitment Rules in respect of the Junior T~chers appointed in pursuance of the recommendations of the Section Committee ln exxstence from trme to time during the pa iod between 1st D:cemb;r 1960, and 22nd epe1mb2r 1913 sball, for all intents and purposes, b: d:ern:d to havc b:en validly and effectively prepared as ifclause (g) of rule 3 of Lhe Rxruitment Rules as amenaed by section 3 were inforce at all ma-arid times when such gradation lists wzre prepared, and accordingIy, no suit or other Iegal proceeding shall b: instituted, maintained or continued in any court OT tnbunal or bzfore other authority merely on tbe ground that those lists were prepared on the basis of the placement givcn by the Selection Committee not constituted by Government inaceordance with the provisions contained in the Recruitment Rulwj as stood prlor to the amendment made under section 3 : Provided that nothing contained in this section shall a f k t the jurisdiction of the Orissa Public Service Commiss~on under subrule (2) d nrIe 8 of the Rzcmitment Rules in detrmining the interse seniority.
