(1)Any vacancy in the office of the member of the Board appointed under clause (xii) of sub-section (4) of section 3 shall be filled as early as possible after occurrence of such vacancy, by appointment and the member so appointed shall hold office for the unexpired term of the member in whose place he has been appointed: Provided that, where any vacancy occurs in the office of any such member within three months preceding the date on which the term of the office of such member expires under section 5, it shall not be filled. (2) Any vacancy in the office of a member, other than the member appointed under clause (xii)of sub-section (4) of Section 3, shall be filled as early as possible after occurrence of such vacancy.
