Compensation in respect of property or right injuriously affected by town planning scheme-The owner of any property. or right which is injuriously affected by the making of a town planning scheme shall, if he makes a claim before the Valuation Officer within the time prescribed by rules , be entitled to be compensaled in respect thereof by the Authority or by any person benefited or partly by the Authorily and partly by such person as the Valuation Officer may in each case determine : Provided that the value of such property or right shall be deemed to be its market value at the date of the publication of the declaration in the Gazette under Sub-section (2) of Section 23 or at the date of the Notification issued by the State Government under Sub-section (1 ) of Section 25, as the case may be, without reference to improvement contemplated in the town planning scheme. s. 70) 0 .
