Setting aside sale Where immoveable property has been sold under this Chapter, the defaulter, or any person owning such property or holding an interest, may, at any time within thirty days from the date of sale or within such further period not exceeding thirty days as the Collector or the Settlement Officer or the Assistant Settlement Officer may for sufficient cause allow, apply in writing to the Collector or the Settlement Officer or the Assistant Settlement Officer to have the sale set aside on the following grounds:– (1) Some materials of irregularity or mistake or fraud resulting in substantial loss or injury to him is established, or (2) On his depositing in the Collector’s office or the Settlement Officer’s office or the Assistant Settlement Officer’s office the amount of the arrear specified in the proclamation of sale, the cost of the sale and for payment to the purchaser a sum equal to five percent of the purchase money.
