(1) The promoter shall be liable to government and to the local authorities for breach of any laws, in respect of the property and the common areas and facilities, till such time as association is formed, and in respect of each apartment, till the date on which possession is given to the apartment owner. Thereafter each apartment owner will be liable in respect of the apartment owned by him and the association will be liable in respect of the common area and facilities. The association will not be liable for breaches committed by an apartment owner. (2) The liabilities of the promoter under Sub-Section (4) and (5) of Section 22, sub-section (3) Section 28 and sub-section (i) of this section, which accrued before possession of an apartment was given to an apartment owner or before an association was formed, will continue against him, even after possession of an apartment is given or the association is formed.
