(1) When any person is convicted of an offence under section 83, the Magistrate may order that the said person shall remove the obstruction or repair the damage or replace ,or. repair the land mark, have! mark, water gauge or apparatus in respect of which the conviction has taken place within a period to be fixed in such order. (2) Without prejudice to the power of the Canal Officer under fiction 74, if such person neglects or refuses to obey such order within the period so fixed, the Canal Officer may carry out the Work in accordance with such order and the cost thereof shall be recoverable ' from such person. ' '
