( a ) No Court shall take cognizance of any offence punishable under this Act, except with the previous sanction of 1 [the Commissioner.] (b) No Court inferior to that of 2 [a Metropolitan Magistrate] or a Magistrate of the First Class shall try any offence punishable under the Act. ( c ) Notwithstanding anything contained in 3 [the Code of Criminal Procedures, 1973 (II of 1974)] an offence punishable under this Act shall be cognizable and bailable.
