Section 5

Term of office.

( 1 ) The State Government shall, as soon as possible after the election held 1 [in accordance with the provisions of section 3A and 4], by notification in the Official Gazette , publish the names of the President, 2 [the Vice-President and the members of the Council.] ( 2 ) The President and the 3 [Vice-President] shall hold office for such period as the State Government may specify in the notification published under sub-section ( 1 ), provided that, such period shall not exceed the term of office of such President or 4 [Vice-President], as a member under subsection ( 3 ). The term shall commence from the date of the notification published under sub-section ( 1 ). ( 3 ) ( a ) 5 [A member of the Council], whether elected or nominated, shall hold office for a period of five years commencing from the date of the notification published under sub-section ( 1 ). (b) 6 * * * * * * ( 4 ) The term of an outgoing President, 7 [Vice-President] or member shall notwithstanding anything contained in sub-section ( 2 ) or ( 3 ) be deemed to extend to and expire with the day immediately preceding the day on which the name of the successor of such President, 8 [Vice-President], or member is published under sub-section ( 1 ). ( 5 ) An outgoing member shall be eligible for re-election or re-nomination. ( 6 ) Notwithstanding anything contained in sub-section ( 3 ), the State Government may, by notification in the Official Gazette , extend from time to time the term of office of the members of 9 [the Council] for a further period not exceeding 10 [three years] in the aggregate.
